The beginning of a prison sentence is often one of the most stressful periods for an inmate, marked by a sudden and drastic change in their life. This stress is felt by the inmate and shared by their family, creating a ripple effect that impacts all aspects of their lives. We provide sentenced individuals and their families with information to help alleviate as much uncertainty as possible. Often, individuals will hire us to accompany them for their surrender to ensure it goes smoothly. We teach our clients tested strategies for communicating with separated loved ones, adjustments to prison life, transferring money to one’s account, and the dynamics of the prison community. We explain the basics of how to use the phone and email systems. We describe the procedures and expectations for family visits and work and discuss assignments and strategies for getting an assignment that fits your needs. We have clients in most federal prisons, and we can often arrange for one of our clients to meet our new clients as they arrive and show them around.
Habeas corpus petitions are vital for challenging unlawful detention or imprisonment. We assist in preparing habeas corpus petitions, ensuring that the petition is presented in the most compelling manner possible. Typical reasons for filing a habeas corpus motion are ineffective assistance of counsel, violation of a constitutional right (such as medical negligence), newly discovered evidence, prosecutorial misconduct, improper jury instructions, and an unlawful sentence.
Compassionate release motions offer a pathway for early release based on extraordinary and compelling circumstances, such as severe medical conditions or family emergencies. We assist in gathering and organizing the necessary medical records and personal documentation to support the compassionate release motion. We prepare compassionate release motions for the client to file, presenting a strong case for early release by highlighting their circumstances and any relevant legal precedents.
A 2255 motion allows defendants to challenge their conviction or sentence based on claims of ineffective assistance of counsel. Our services in this area include conducting a thorough review of the client’s trial and sentencing to identify any instances of ineffective assistance of counsel that may have impacted the outcome.
Designation requests involve advocating for the client’s placement in a preferred correctional facility. We communicate directly with the Bureau of Prisons’ Designation section to advocate for our client’s placement in the facility where they wish to serve their time. Our proactive approach ensures that the client’s preferences are considered and accommodated whenever possible. We also provide detailed information about different prisons, including security levels, available programs, and proximity to family, to help clients make informed decisions about where they want to serve their sentence.
The Residential Drug Abuse Program (RDAP) is a comprehensive, voluntary substance abuse treatment program available to federal inmates in the United States. It is administered by the Federal Bureau of Prisons (BOP) and is considered the most intensive drug treatment program available in the federal prison system. RDAP typically lasts 9 months, during which participants receive 500 hours of programming. One of the most significant benefits of RDAP is the potential for a reduction in sentence. Inmates who complete the program can receive up to a 12-month reduction in their sentence, depending on their offense and sentence length. Participants may also be eligible for early release to a Residential Reentry Center (halfway house) or home confinement, where they continue their transition back into the community under less restrictive conditions. We help clients evaluate their ability to qualify for this program and, if applicable, help them advocate for admittance.
Obtaining credit for time served and participation in rehabilitation programs can significantly impact a client’s sentence. We educate clients on the various credits available under the First Step Act (FSA) and other programs. The BOP often makes mistakes, and we advocate for our clients to ensure that all eligible credits are applied to their sentences. We also work with prison authorities to address any discrepancies or issues.
Early release to a halfway house or home confinement can significantly shorten the time spent in prison and ease the transition from incarceration to community life. Our team assists in gathering and organizing the necessary documentation, including evidence of rehabilitation and plans for reintegration, to support the early release request. We work directly with the Bureau of Prisons to advocate for our client’s early release, presenting a solid case for their readiness to transition to a less restrictive environment.
